  1. Contracts

    Stick to writing what you know about, websites. Hire a professional lawyer that specializes in software litigation to write a contract for you to use. If you are serious about “free-lancing” don’t risk a disaster because you were too cheap to spend a few hundred bucks. What if lawyers tried to design web sites? It would probably have the same result as you trying to write your own contract.

      Eeep! Not a software litigation lawyer! Most lawyers who focus on litigation don’t do much transactional (contract-making) work, and would only be really sharp on the copyright issues. Copyright in Steph’s work will most likely belong to the person contracting her, under the work-for-hire doctrine, though that’s really the only intellectual property issue involved. (Few people will pay to have something designed for them if they don’t own it at the end.) A professional lawyer who does contracts for independent contractors and is aware of what web design generally involves is probably most appropriate. The lawyer doesn’t need to know how to write Java applets, perl scripts, or Flash, erm, things (what is a bit of Flash code called anyway?). If there are any associations of people who do art/design work on an independent contractor basis, they may be able to recommend someone.

      I highly recommend seeking a professional lawyer out on the matter, too. I understand, though, that it’s hard to swallow that kind of expense up front when it’s only likely to pay off over a long time. Legal-self-help books written for laypersons cannot teach one how to watch out for all the pitfalls that might arise as part of one’s own particular situation. But then, I’m biased — I’m starting my third year of law school.
